Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to hazardous conditions by failing to provide information and or training regarding safe operations and or procedures while working on or around earth moving equipment: a) 3 & 5 Arthur Street, Bridgewater, NJ 08807. The employer did not provide any information and or training regarding safe operations and or procedures while working on or around earth moving equipment, i.e. backhoe. Condition observed by CSHO on or about 09/20/06. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, WOULD BE FOR THE COMPANY TO INITIATE AND MAINTAIN A SAFETY AND HEALTH PROGRAM AND PROVIDE ADDITIONAL TRAINING FOR EMPLOYEES WORKING ON OR AROUND EARTH MOVING EQUIPMENT.
