Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a struck by hazard:
a) Port Murray, NJ - Borealis Compounds location  The employer failed to
develop safe
operation procedures for the tamper machine that includes precautions for
employees
working in close proximity of the tamper.
Violation disclosed on or about 12/21/06.
Feasible and acceptable methods of abatement to correct this hazard
include but are not
limited to the following:
a) Develop and implement standard operating procedures (SOPs) for the safe
work
practices to be followed by all employees who are working on the same
track.
b) Have a monitor/watchperson oversee the activities while machines and
employees work
on the same track.
c) Use a derailer or put a chain on the track while machines and employees
work in close
proximity to each other.ity
