Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to inhalation hazards: a) Central Weigh Department-The employer failed to provide a workplace where employees' exposure to Active Pharmaceutical Ingredients (API) such as, but not limited to, those contained in Alprazolam which were above the Occupational Exposure Limits (OEL) as recommended by the Occupational Toxicology Roundtable (OTR). Employees were exposed to Alprazolam at 257 ug/m3 as 8-hour Time Weighted Average (TWA) concentration which was 128.5 times the OEL of 2 ug/m3. Zero exposure was assumed for the unsampled time period. Condition noted on or about 6/19/07. b) Granulation Department-The employer failed to provide a workplace where employees' exposure to APIs such as, but not limited to, those contained in Alprazolam which were above the OEL as recommended by the OTR. Employees were exposed to Alprazolam at 156.8 ug/m3 as 8-hour TWA concentration which was 78.4 times the OEL of 2 ug/m3. Zero exposure was assumed for the unsampled time period. Condition noted on or about 6/19/07. Feasible and acceptable methods of abatement to correct this hazard include but are not limited to the following: a) Effective respiratory protection shall be provided and used by exposed employees as an interim protective measure until feasible engineering and/or administrative controls can be implemented, or whenever such controls fail to reduce employee exposure to within permissible exposure limits. b) Implementation of engineering and/or engineering controls shall be implemented to reduce employee exposure to the lowest amount possible.
