Section 5(a)(1) the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by a compact excavator in the event of a rollover: a) 1821 South Second Avenue, Highland Park NJ. Employee operating a Kubota Super Series KX 91-3 excavator was exposed to crushing hazard(s) due to failure to wear restraint device and failure to operate the equipment while seated in the operator's seat. Condition noted on or about 08/23/07. AMONG OTHER MEANS, FEASIBLE AND ACCEPTABLE METHODS TO CORRECT THIS HAZARD WOULD BE FOR THE COMPANY TO REQUIRE EMPLOYEES TO UTILIZE MANUFACTURER'S SUPPLIED SEATBELTS DURING COMPACT EXCAVATOR OPERATIONS, REQUIRE THE EQUIPMENT OPERATOR TO REMAIN SEATED WHEN OPERATING ANY EXCAVATING EQUIPMENT, AND ADD THESE REQUIREMENTS TO THE EMPLOYEE'S TRAINING PROGRAM.
