Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employee in that
employees were exposed to being struck by tow rope:
a) 8 Engelhard Avenue, Avenel, NJ 07001. The employer allowed his
employees to
use a tow rope attached to a forklift to reposition rail car for off
loading exposing him
to struck by hazards. Condition noted on or about 09/07/07.
ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD,
AMONG OTHER MEANS, WOULD BE FOR THE OWNER TO PURCHASE AND
OR RENT THE APPROPRIATE EQUIPMENT, I.E. POWER PUSHERS, TUGGERS
AND RAIL CAR MOVERS FOR THE REPOSITIONING AND OR RELOCATING OF
RAIL CARS.
