Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazardous conditions by falling and crushing hazards: a) Mile marker 101.7, NJ Turnpike, North Maintenance Yard, Elizabeth, NJ 07208. The employee was exposed to falling and crushing hazards when he was allowed to work in close proximity to concrete Jersey Barriers that were not secured with stakes and or side boards that would prevent them from sliding off the flat bed platform. Condition observed on or about 09/28/07. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, WOULD BE FOR THE COMPANY TO PROTECT THEIR EMPLOYEES AGAINST SHIFTING AND OR FALLING LOADS BY REQUIRING VEHICLES TO HAVE SIDES, SIDE BOARDS AND OR STAKES WHEN THE MATERIAL BEING LOADED IS NOT STRAPPED OR BANDED.
