Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling during tree trimming operations: (a) Location 8 Monterey Drive, Bristol, RI: On or about 9/7/06, an employee was injured as a result of a 25-30 foot fall from a tree. The employee, while jumping 3-4 feet from a tree to an adjacent tree branch that did not support his weight, did not use adequate fall protection. Among other methods, one feasible means of abatement would be: According the The American National Standards Institute Z133.1-2000, section 9.1.2, which states that arborists shall be tied in or secured while ascending the tree and remain tied in or secured until the work is completed and they have returned to the ground. OR IN THE ALTERNATIVE, 29 CFR 1910.132(a): Protective equipment, including protective shields and barriers, was not provided where necessary whenever hazards capable or causing injury and impairment were encountered: a) Jobsite; 8 Monterey Drive, Bristol, RI: A personal fall arrest system or equivalent fall protection was not provided where employees were exposed to falls of approxiately 25 feet from a tree while performing pruning operations on or about 9/7/06.
