Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to possible impalement hazards: The employer failed to ensure
that the obsolete
upright for the handrails to the stairs were protected to prevent
impalement hazards to employees
working above from the unguarded scaffolding. Among other methods, a
feasible means of
abatement would be; To cut and remove the uprights at the base level which
would eliminate
the impalement hazards.
Location:  Job site.
The employees were exposed to impalement hazards from the unprotected steel
pipe uprights to the old hand rails on the concrete steps.  The workers
were
working from a carpenters bracket scaffold in excess of 10 feet high which
was
not provided with fall protection.
