Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard while standing/working from the forks of an powered industrial truck: a) Liberty Harbor, Jersey City, NJ. Employee was standing/working from the fork of an powered industrial truck, thereby exposing the employee to a fall hazard. Violation occurred on or about 06/20/2006. "Among other methods, one feasible and acceptable abatement method to correct this hazard is for employees to be trained in the hazard of not using the fork as a platform as per the ANSI- A92-2-1969 consensus standard follow by the Owner/operator manual.
