Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)Warehouse - On or about 08/02/06, overhead cranes with missing and/or damaged safety latches. Among other methods, one feasible and acceptable method to correct this hazard would be the installation of a safety latch on the hook as recognized in 1910.181(j)(2)(ii) which states "Safety latch type hooks shall be used wherever possible." Also to comply with the requirements of the American Society of Mechanical Engineer Standard ASME B30.10-1993, Hooks, Section 10- 1.1.1.2(b).
