Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the jobsite, located at 5900 Stoney Brook Road, Rogers, Arkansas, an employee was exposed to crushing injuries while operating a Rough Terrain Forklift without the use of a seat belt to move materials at this site. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish a policy that requires: the use of seat belts, communication of the policy to employees, and enforcement of the use of seat belt
