Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the job site, employees were observed exiting the roof of a two story building, by means of a man basket attached to an extensible boom, approximately 20 feet above the level below. They were not provided a safe means of accessing the lift basket from the roof, such as but not limited to personal fall arrest systems, exposing them to the hazards of falls from elevation.
