Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about July 2006, employees were allowed to work at heights from pallets which were supported by the forks of industrial trucks in order to stock and retrieve tires from storage racks. The employees were not provided any means of fall protection and, thereby were exposed to falls of up to 20 feet to the ground. Among other methods, feasible and acceptable abatement methods include following the requires for lifting personnel explained in the ANSI/ASME B45.1-2000 Safety Standard for Low and High Lift Trucks.d
