Section 5(a)(1) of the Occupational safety and Health Act of 1970:  the
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees
were exposed to caught-
between and struck-by hazards:
a. On or about November 16, 2006, at the above addressed jobsite,  LULL
Model 844C rough
terrain forklift trucks were used to move the Bennu Innovation Scaffolding
System from the
North to East wall through an area of the jobsite which had soft mud,
standing water and
obstacles, such as a manhole; thereby employees were exposed to struck-by
and caught-in
between hazards associated with the forklift tipping-over and/or losing
its load. Among other
methods, one feasible and acceptable means of abatement would be to follow
the manufacturer's
operator's manual which states; KNOW THE WORK AREA: Walk around the
worksite and
inspect the terrain that you will be traveling on. Make note of surfaces
to
be avoided,  including
holes & drop-offs, obstacles, soft mud& standing water and oil spills &
slippery surfaces. If any
of the above conditions exist in the work area, correct the condition
before operating. If the
condition cannot be corrected, avoid operation in the problem area.em
