Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about December 20, 2006-at the above addressed jobsite, employees installing aluminum window frames were using a Terex extensible boom aerial lift to lift frames in place. The employees were exposed to injuries related to tip over of the aerial lift. One feasible and acceptable abatement method, among others, would be to comply with the Terex operators manual and/or the American National Standards Institute/Scaffold Institute Association (ANSI/SIA A92.5-1992)Standard for Boom Supported Elevated Work Platforms which does not allow aerial lifts to be used as cranes.
