Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about February 12, 2007, employee exposed to fall and caught-in-between hazards while working from the elevated bucket attachment of the Lull rough terrain fork lift to cover the scaffold with plastic. Among other methods, feasible and acceptable abatement methods include, but are not limited to the following: comply with the American Society of Mechanical Engineers (ASME) standard B56.6-2002, entitled," Safety Standard for Rough Terrain Forklift Trucks", section 5.15,"Elevating Personnel", and 8.24, "Platforms for Elevating Personnel".
