Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and tip-over hazards: Sunny Border Nurseries: An employee was injuried when the tractor he was using tipped over and pinned the employee underneath the tractor. The brakes on the tractor did not function properly. The brakes on the tractor had not been checked or worked on since 2002. The manufacturers' recommendations state that the brake linkage must be lubricated every 120 hours and adjustments of the brakes must be done at regular intervals as well as regular inspections of the linkages, pins, and cotters. Among other methods, the following is a feasible and useful method to correct the hazards: Institute a daily, weekly, and/or monthly maintenance and inspection program for each farm tractor.
