Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to an engulfment hazard: a) Farm: Employees moving & picking mulch with a backhoe loader were exposed to an engulfment hazard while operating the equipment under a mulch pile which was approximately 30 feet high. Among other methods, one feasible and acceptable method to correct this hazard is to use the proper equipment to remove mulch from the 30 foot pile. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS VIOLATION.
