Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from an aerial lift that was being used improperly: On or about 09/26/06, employees were engaged in the task of pulling a suspended scaffold off the ledge of the first floor using a rope that was tied on one end to the suspended scaffold and the other to the boom of an aerial lift, exposing employees to a struck-by hazard. Among other methods, one feasible and acceptable method to correct this hazard is for the employer to prohibit equipment operators from deviating from the manufacturer's recommended operations of not placing or attaching loads to any part of the machine. PLEASE NOTE: CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS VIOLATION.
