Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to struck-by/crushing, run over, and drowning hazards: On or about 10/16/06, at Boca West community, employees were exposed to struck-by/crushing, run over, and drowning hazards when operating riding lawn mowing equipment on steep slopes near bodies of water without wearing the equipment's seat belt, roll over protection disengaged, and no personal flotation device. Among other methods of abatement, one feasible and acceptable method to correct the hazards is to implement a safety policy requiring the use of the roll over protection, seat belts, flotation devices available when operating this type of equipment, and following the operation instructions in the John Deere riding lawn mower manufacturer's manual, which indicates not to drive the equipment where it could slip or tip and to keep it away from drop offs and embankments. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
