Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: On or about 03/27/07, at berth 32 in Port Everglades, a means of fall protection was not provided to employees who remove rigging hooks from the top corners of intermodal containers that are stacked one (1) container or greater on a dock, exposing employees to the hazard of falling approximately nine (9) feet six (6) inches to ground level. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to prohibit employees from conducting work from the top of intermodal containers without the use of a fall protection system. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
