Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) Employees are required to work at heights up to 11 feet from an elevated man basket which had the guard rail height at less then 42 inches and there was no mid-rail in place, on or about April 13, 2007. Among other methods, one feasible and acceptable abatement method to correct these hazards is to provide guidelines that must be followed when personnel are elevated on work platforms of powered industrial trucks as set forth in Sections 4.17 and 7.35.3 of ASME B56.1-1993. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
