Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees exposed to
being struck by or caught between heavy equipment vehicles:
a) Little Wolf Creek Reclamation Project, 741 Burma Road, St. Clair, Pa: A
mechanic drove
his service truck into the blind spot on the right side of a 165 ton
Caterpillar end dump
truck, Model 785B. As the dump truck moved forward it ran over the service
truck with the
driver still in it, on August 01, 2007.
Among other methods, one feasible and acceptable abatement method to
correct this hazard
is to: a) Develop and implement a comprehensive written safety and health
program and train
all employees in the program elements prior to their entry onto
reclamation sites. At a
minimum, the training program should include: How to recognize hazards and
how
to work
safely around equipment that have blind spots. b) Establish a positive
communication system
between all mobile and heavy equipment operators.
