Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential dust explosion hazard that could have resulted from or been exacerbated by the failure to locate dust collectors that collect combustible dust outside of the building: (a) The Dust Tech Inc. dust collector, which collects wood dusts that are potentially explosive, was located inside the building in the main production area, on or about 2007. ABATEMENT CERTIFICATION REQUIRED ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct these hazards includes following NFPA 664 Standard for the Prevention of Fires and Explosions in Wood Processing and Woodworking Facilities including, but not limited to,: (a) Relocate the dust collector outside or as required by paragraph 8.2.2.5.1.4 of NFPA 664.
