North Carolina General Statute 95-129 (1) of the Safety and Health
Act of North Carolina: The employer did not furnish to each of his
employees conditions of employment and a place of employment which
were free from recognized hazards that were causing or likely to
cause death or serious physical harm to employees in that employees
were exposed to crushing and struck by hazards:
a)jobsite, on 07/26/06, for the employees operating a
Kubota model 6100 tractor.  The employer failed to
provide and require the use of seat belts and roll over
protection on Kubota model 6100 tractors.
In the Alternative:
29 CFR 1910.132(a)(1): Protective equipment was provided and
used when necessary whenever hazards capable of causing injury
and impairment were encountered:
a)jobsite, on 07/26/06, for the employees operating a
Kubota model 6100 tractor.  The employer failed to
provide and require the use of seat belts and roll over
protection on Kubota model 6100 tractors.
Abatement note: Among other methods, one feasible method
to reduce this hazard would to install the roll over
protection structure and seat belts that are available
from Kubota Tractor.
