Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish to each of his employees a place of employment which was free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of being knocked off the work
platform and placed into
contact with energized power lines while working from a JLG Skytrak
telehandler, model
#10054.  The operator maneuvered the boom of the telehandler while
standing on the ground
outside of the operator's seat.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to have the telehandler operator positioned in the operator's seat and the
seat belt fastened before
starting to operate the equipment in accordance with paragraph 5.15.1 (s)
and 6.2.1(a) of The
American Society of Mechanical Engineers (ASME) B56.6-1992, Safety
Standard for Rough
Terrain Forklift Trucks.
