General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to the hazard of being crushed by the Nissan 50 (Model CPH02A25V) propane powered industrial forklift truck in the event of a tip over accident. Throughout the shop; A seat belt was not provided for the operators of the Nissan 50 (Model CPHO2A25V) propane powered industrial truck that was being used to unload materials and setting signs on trailers. The employees were exposed to the hazards of being crushed by potential roll-over action of the fork trucks. Among other methods, one feasible and acceptable method to correct this hazard would be to install a seat belt on the Nissan 50 fork truck and to enforce the requirement that the operators use the seat belts. The employer is responsible for selecting and carrying out an appropriate method of abatement.
