Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to:
a)the hazard being struck by portions of a vacuum truck equipment while
removing
the scrubber dome cap while the tank was pressurized. On or about August
30,
2006 at the jobsite located at Herbert Junction off Hwy 93, Beaumont, TX
where
employee was attempting to open scrubber dome on Truck/Tank Trailer #WHP -
2062 TLP # 2DB-246. Several feasible and acceptable abatement are available
to protect employees from this hazard , including but not limited to: 1)
establish
and implement a procedure among the Vacuum truck drivers that would
prohibit
them from removing the scrubber dome cap without first insuring that the
tank
was depressurized.
