Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: fall hazards on or about June 26, 2006 at 4144 Boardwalk Blvd, Seabrook, TX, "The Point on Taylor Lake" when employees and roofing supplies are lifted to or lowered from the roof of a 3 story (approx. 30 ft.) wood frame building using a wooden pallet on the forks of a 534 C Gradall rough terrain forklift. Among other methods,one feasible and acceptable abatement method is to: Ensure that the provisions of ASME B56.6-2002, Safety Standard For Rough Terrain Forklift Trucks, Section 5.15.1, a through y, are followed for protection of personnel lifted on forklifts.
