Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-in- between hazards: (a)At 4104 Leeland St in Houston, Texas and on or about February 13, 2007 and continuing thereafter, employees were exposed to caught-in-between hazards when the conveyor belt in the bulk packaging area was started without any warning mean such as but not limited to an audible signal or by a designated person providing the warning. There is no warning device or other methods/procedures utilized on the conveyor system which would notify employees as to the upcoming start or movement of the conveyor belt system. Among other methods,one feasible and acceptable abatement method is to: Ensure that the procedures in the American National Standards Institute (ANSI), Safety Requirements for Bakery Equipment,ANSI Z-50.1-1971, section 8.3.5 are followed: Employees in the area are alerted by signal or a designated person that the conveyor is about to start; An audible device could be provided which can be clearly heard at all points along the conveyor where the employees are present; The warning device should be actuated by the controller device starting the conveyor and should continue for a required period of time before the conveyor starts (delay timer); The use a flashing light or similar visual warning used in conjunction with or in place of the audible device should also be used or by whichever system is more effective in particular circumstances.
