Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards when working on top of rolling stock, including rail cars and truck trailers. In the East Tank Farm, employees are exposed to a fall hazard when working from open sided platforms on top of truck trailers at loading spots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 13 and 52. In the Central Tank Farm, East Tank Farm and West Tank Farm, employees are exposed to a fall hazard when working from open sided platforms on top of rail cars along rail lines 734, 735, 751, 750, 741, 742, and 743. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install removable guardrailing on the top of the rail cars and truck trailers, such has been installed at one truck spot and two rail spots at the facility, with the use of personal fall arrest systems in the interim.
