Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fire and explosion hazards:
(a) Gordon Terminal Service Loading Station # 6: On or about 07/17/07
employees were top loadeing a tanker by hose through the open hatchways
with
Tufflo 150, a petroleum product.  The tanker had previously contained a
Class
1 flammable liquid and the proper precautions to prevent hazards due to a
change
in flashpoint were not taken thus an explosion and fire occurred seriously
injuring
a worker.
Among other methods, one feasible and acceptable means of abatement to
correct
this hazard is to ensure that proper precautions are taken, as referenced
by the
National Fire Protection Association, NFPA 30-2003, when there is a change
in
flashpoint.  Additionally, employees need to use a Lower Explosion Limit
(LEL)
meter anytime a tanker is opened to measure the LEL of the atmosphere
inside
the tanker to ensure that a flammable atmosphere does not exist before
continuing
operations.
