North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to fall or struck by hazards:
(a)  Facility, lower shop - two 5 ton underhung Jib Cranes were not load
tested as required.
(b)  Facility, maintenance shop - Monorail crane system was not load
tested as required.

(b)  Electric Powered or Air Powered Hoists
(1)  Complete new hoists shall be dynamically load tested by the
manufacturer as specified
in paragraphs 16-2.2.1(b)(1) and (2) with a load test not less than 125
of the rated
load, except that if testing cannot be performed by the manufacturer, the
user shall be
notified and the load test shall be accomplished at another location or
job site, by or
under the direction of a designated person prior to the hoist being placed
into service.
(The user is testing the complete structure wether or not the hoist was
tested by the
manufacturer.)
(c)  The person conducting the load test shall prepare a written report of
the load sustained during the
test and the operations performed during the test.  Reports must be placed
on file.
NOTE:  Among other methods, one feasible and acceptable method to correct
this hazard is to load test the
underhung hoists as required and maintain records of the load tests.

(a)Periodic inspections shall be performed at intervals defined in para.
11-2.1.1(b)(2):  Visual
inspection by an appointed person making records of apparent external
conditions to provide the
basis for a continuing evaluation, as follows:  normal service, equipment
in place ---  annually.
(c) A qualified person shall examine any deficiencies found during the
inspection to determine
whether conditions found constitute a hazard, require disassembly for
further inspection, or
require replacement.
NOTE:  Among other methods, one feasible acceptable abatement method to
correct this hazard is to conduct
annual, periodic inspections on the crane systems per the requirements of
section
11-2.1.3 of ANSI B30-11-1998.

(a)  Facility, lower shop- The rated load was not marked on the under the
hook lifting device which was
attached to one 5 ton hoist on the overhead bridge crane.

(a)Rated load marking.  The rated load of the lifting device shall be
marked on the structure
where it is visible.
(b)Identification.  A nameplate or other permanent marking shall be
affixed
displaying the
following information:
(1)Manufacture's name
(2)Serial number
(3)Lifter weight, if over 100 lbs.
(4)Rated load
NOTE:  Among other methods, one feasible and acceptable method to correct
this hazard is to properly mark
the rated load on the below the hook lifting device.
