North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall to lower surface and crushing hazard while operating a rough terrain forklift: a)construction site, employees were not utilizing a seat belt while operating the JLG SkyTrak 5028 Rough Terrain Forklift. NOTE:Among other methods, one feasible and acceptable method to abate the hazard would be to install and utilize a seat belt while operating the forklift per American Society of Mechanical Engineers (ASME) B56.6-2002 Safety Standard for Rough Terrain Forklift Trucks and the JLG SkyTrak 5028 Owner's Manual.
