Labor and Employment Article, Section 5-104(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a)Date of Violation:09/18/06 Condition:Employees operated a Smithco Super Rake in and around a golf course sand bunker, on a slope which varied from 24 degrees to 50 degrees where the three-wheeled vehicle was not stable and subject to roll-over. Among other methods, one feasible and acceptable method to correct this hazard is to rake the sand by hand and eliminate the use of the vehicle on grades of 20 degrees or more in accordance with the manufacturer's recommendations.
