A.  Employer knew or should have known that unprotected protruding rebar,

landscaping markers at the front of the building, exposed employees
working from JLG
aerial lift basket in the area to an impalement hazard.  A feasible
method, among other
methods, to correct this hazard is to properly cap or otherwise guard the
rebar.
