Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to the hazards of falling from an elevation and/or struck-by:
On or about October 16, 2006, and at times prior and after thereto,
employees were
exposed to falls and struck-by hazards where the personnel platform was
attached to a
Nissan Forklift, Serial No. 9C2206, and operated in a manner and condition
for which
it was not designed or intended:
a) The operator of the forklift repeatedly maneuvered the vehicle
horizontally forward
and reverse with the personnel platform raised approximately 28 feet above
the level
below. Employees within the elevated personnel platform were exposed to
the
hazards
of being thrown from the personnel platform by the sudden change in
direction of the
vehicle.
b) The combined weights of the platform, personnel, and loads exceeded the
industrial
truck's capacity exemplified by the counterweight and rear wheels lifting
from the floor
while pulling and lifting pallets with the personnel basket and employee
elevated. The
platform used to lift personnel did not have information prominently
displayed to indicate
the maximum load, weight of platform, and minimum capacity of the truck on
which it
can be used.
Among other methods, some feasible and acceptable abatement methods to
correct these
hazards are as follows:
1) Do not exceed one-half the capacity of the combined weight of the
platform,
load, and
personnel as required by ANSI/ITSDF B56.1-2005, Section 4.17.3(o);
2) Place travel controls in neutral and set the parking brake when an
employee is elevated
on the platform as required by ANSI/ITSDF B56.1-2005, Section 4.17.3 (g);
3) Maneuver the platform slowly, only for minor adjustments in horizontal
positions
when personnel are on the platform as required by ANSI/ITSDF B56.1-2005,
Section
4.17.3(l);
4) Ensure all information is prominently indicated on the platform as
required by
ANSI/ITSDF B56.1-2005, Section 7.37.3(i).

that employees were
exposed to the hazard of falling from an elevation:
On or about October 16, 2006, and at times prior and after thereto,
employees were
exposed to the hazards of falling approximately 28 feet to the level below
when exiting
and reentering the personnel platform attached to the Nissan forklift,
Serial No. 9C2206
while attempting to free jammed pallets.
Among other methods, one feasible and acceptable abatement method to
correct this
hazard is to use a piece of equipment designed to lift personnel to
another platform or
level equipped with a gate or door for safely entering and exiting as
required by
ANSI/ITSDF B56.1-2005,  Sections 4.17.3(p) & (r) which prohibits using a
platform
attached to a forklift for entering and exiting except at ground level,
and requires
personnel to remain on the platform while in the basket.
