Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: Stairway leading up to rig floor from ground level (Rig #1); On or about 11-15-06 the employer did not ensure that stairway used by employees for access to and from the rig floor was secured and equipped with mid-railing at the landing area end. Pins were not inserted into slots that were attached to the stairway system. This condition exposed employee(s) to falling 12' to ground level. Among other methods, one method of abatement is for the employer to comply with the American Petroleum Institute Recommended Practice RP54-Paragraph 9.3.8 states that; "All with handrails and midrails extending the entire length of the stairway." Among other methods, one method of abatement is to insert proper fitting pins into the slots attached to the stairway system.
