Section 12-60-2(a)(3) Hawaii Administrative Rules, was violated because:
There were three instances of employees being exposed to fall protection
hazards while painting the roof trim.
1) A 24-foot aluminum extension ladder was being used by two employees to
gain access to the 15 foot low
slope roof. The ladder extended 12 inches above the upper landing surface.
2) Two employees were using the
top step of an 8-foot fiberglass step ladder to access the second story
roof. 3) The employees were working on
the roof 23 feet above the lower level without any means of fall
protection.  The potential of the fall to
the lower level will result in serious injury or death.
12-60-2(a)(3) states  Every employer shall provide safe work places and
practices by elimination or
reduction of existing or potential hazards.  Elimination of existing or
potential hazards by design,
process substitution, or other appropriate methods is preferred because it
eliminates the need for
further employee protection.  When elimination is not feasible, reduction
of existing or potential
hazards to acceptable levels, using methods such as engineering or
administrative controls, isolation,
or guarding, shall be promptly used.  When these methods are inadequate to
reach acceptable levels,
personal protective equipment shall be provided and used.
