employer did not furnish to each of his employees conditions of employment
and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to
employees in that employees were exposed to being struck or caught in
between:
a)  the rollover protections in the event employee was thrown off one of
the ten forklifts. Employees
operating ten of the twelve forklifts (Yale, Mitsubish, Hyster, and
Komatsu) that were not provided
with seatbelts installed per manufacture requirements based on seatbelt
anchoring plates being installed
exposing them to being caught in between/crushed from not being able to
use seatbelts.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to install, train,
and require employees to wear seatbelts.
