North Carolina General Statute 95-129(1) of the Occupational Safety & Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)shop area - being caught between the forklift's frame and the ground in the event of the vehicle was upset or turned over. The operator was not wearing a seatbelt while operating the Clark forklift truck. Abatement Note: one feasible and acceptable abatement method to correct this hazard was to install a seatbelt and require the operator to wear the installed seatbelt while operating the forklift.
