North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to falls to a lower level: a)jobsite, an employee working within the metal basket elevated by a rough terrain vehicle that could articulate, and wearing fall protection, did not attach the lanyard to an anchor point either while standing on its floor or mid-rail;the employee was working 11 feet above the lower level. Among other methods, one feasible and acceptable abatement method to correct this hazard was to tie off to the anchor point with the lanyard.
