North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall from elevation: a)jobsite at 2051 Mallard Lakes Drive, Winston-Salem, NC 27106- on or about 3/14/07 an employee was standing in the bucket of a Kobelco Mark IV Excavator approximately 20 feet above the next lower level (residential road) tying Communication cable lines to an electrical service support cable. b)jobsite at 2051 Mallard Lakes Drive, Winston-Salem, NC 27106- on 3/15/07 an employee was standing in the bucket of a Kobelco Mark IV the Excavator approximately 20 feet above the next lower level (residential road) and was tying communication cable to an electrical support cable and an overhead energized electric power line, (7200 Volt AC) contact with the energized power line resulted in the employee's death on 03/24/07.s
