North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer id not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards and were causing or likely to cause death or serious physical harm by being stuck-by or crushed by forklift in that no seatbelts were provided in the event of a tip-over: a)plant, two forklift operators were not required to wear seatbelts while operating the Mitsubishis (#5 and #15) within the warehouse while transporting products. Among other methods, one feasible and acceptable abatement method to correct this hazards is to require operators to wear their seatbelts.
