Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to trips, falls and "stepped into" injuries. In the following instances, drivers were exposed to trips, falls and "stepped into" injuries: a)Bangor, ME terminal - On or about the first week of October 2006, a driver stepped on the edge of the pallet when he stepped off the van's rear bumper backwards. When the pallet flipped up, the driver fell backwards resulting in back pain. b)Bangor, ME terminal - On or about October 10, 2006, a driver stepped into one of the elliptical shaped openings in the pallet and bent his knee backwards resulting in a serious knee sprain while trying to pass another driver in the aisles between the pallets. Among other methods, one feasible and acceptable method to correct this hazard is to use a basket or cart with casters that has a spring loaded platform.
