Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of being struck by a hydraulic vehicle lift:
a) On or about October 4, 2006, the employer failed to ensure the safety
of the employee(s) in
that the locking device on the Rotary Automotive lift number one, located
in the shop was not
functioning properly. The safety latch for the lift was clogged with dirt,
oil and grease and
would not activate.
b) On or about October 4, 2006, the employer failed to conduct daily
inspections on the Rotary
Auto lifts #1 through #3 to ensure reliability and safe operation of the
lift.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to follow ANSI/ALOIM-2000, (Operator Responsibilities), Section 4.4.4,
(Operator Reporting)
Section 4.5, (Qualified Inspection Procedures), Section 5.1, and
(Inspection Points), Section
5.6.2.16.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that the abatement is complete must
be included
with your certification. This documentation may include, but is not
limited to, evidence of
the purchase or repair of the equipment, photographic or video evidence of
abatement, or
other written records.
