Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck or falling from the cab: a) On or about 10/31/06 on Transit Rd near High St. An employee was observed riding outside of the cab, on the side of a John Deere 410G Tractor traveling north along Transit Rd. in heavy traffic. The employee was standing on one foot on the access step between the front and rear wheels on the left side of the cab. The employee was exposed to falling from the side of the tractor and being crushed and/or struck by the moving tractor. The employee was also exposed to being struck by the southbound traffic which just a few feet away. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO FOLLOW THE MANUFACTURE'S OPERATING MANUAL WHICH PROHIBITS ANYONE OTHER THAN THE OPERATOR TO BE ON THE MACHINE WHILE IT IS BEING OPERATED. NO ABATEMENT CERTIFICATION REQUIRED
