Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
Being struck by vehicles due to poor illumination.
a) Within the establishment, located at 900 N. Rice, Hamilton, Texas.
On or about September 4, 2007, and times prior thereto, the employer did
not ensure that
adequate illumination was being maintained for employees performing the
trucks loading and
moving operations in and out of the shops bay and open yard areas within
the establishment,
exposing employees to being struck-by the moving truck cranes due to
inadequate illumination.
Among other methods, one feasible and acceptable means to abate this
hazard is to provide the
lighting within the open yard parking area in accordance with ANSI/IESNA
RP 7-01 "American
National Standard Practice for Industrial Lighting"; to provide and
enforce the use of high-
visibility reflective safety vests to ensure that the employees would be
visible to vehicular traffic;
to maintain a safe vehicular distance when each truck is awaiting loading
by parking each truck
behind not along side another truck through work practices; and to provide
back-up alarms up
on all trucks.
Pursuant to 29 CFR 1903.19, the employer must provide certification and
documentation of
abatement of this item.
