Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard from the storage rack: On or about February 21, 2008, and times prior thereto, the employer did not ensure that a 5 feet steel storage rack was anchored to the floor to prevent it from being pulled down. Feasible and acceptable method to correct this hazard is: 1. Follow all installation instruction by the manufacturer. 2. Anchor all steel storage racks that are 5 feet high.
