Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about November 4, 2006, employees working on the top of a water tank were exposed to the hazard of being struck-by a swivel arm when it was moved by a hoist and derrick. Among other methods, one recognized and feasible means of abatement includes, but is not limited to, utilization of a positive two-way means of communication between the personnel at the top of the tank and the hoist operator on the ground to ensure all workers on the tank are in a safe zone.
